Term & Conditions (Updated June 2024)

The terms and conditions on which we provide our services to our clients is set out below. Please note that by booking an appointment you acknowledge that you have read, understood and agree to these terms and conditions.

The following terminology applies to these Terms and Conditions and any or all agreements. “Client”, “Customer”, “You”, “Your” and “Patients” refer to you, the person who is booking and the client attending the appointment.

“The Company”, “Ourselves”, “We” and “Us”, refers to Blackabey’s. Blackabey’s is a trading name of Imagent Limited, a company incorporated and registered in England and wales with company number 13697199, and whose registered office is at Suite 12, East Wing Jason House, Kerry Hill, Horsforth, Leeds, West Yorkshire, England, LS18 4JR. “Party” and “Parties” refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law.

Consultations and Appointments

Please arrive for your appointment at least 10 minutes in advance so that the necessary paperwork can be completed. Late arrival may result in reduced treatment time or forfeiting of the appointment. BLACKABEY’S will endeavour to ensure that your appointment runs to time; however, should we need to cancel or postpone your appointment at short notice, we will make every effort to contact you in advance.

We will inform you of any preparation required in advance of your treatment. Failure to follow the preparation guidelines (including purchase of mandatory skincare) may result in cancellation of your appointment, reduced treatment time, or additional fees being charged.

Any client who requires treatment and brings a child with them must also be accompanied by another adult to chaperone the child whilst the client is being treated. Failure to bring an adult chaperone with any child will result in the treatment being cancelled and loss of the deposit. No children under the age of 16 years must be left unattended within the clinic at any time.

Time slots are allocated in accordance with the services required. If you are more than 15 minutes late your appointment may be cancelled and rescheduled. As a result your deposit will not be refunded.

Following initial consultation, patients have a maximum of 6 months to proceed with treatment including the purchase of skincare. if there is no attendance for treatment in the 6 months following initial consultation, patients will not be able to book a treatment and will need to book a new face to face consultation in order to ensure patient safety to proceed with treatment.

Age Restrictions

For injectable treatments (anti-wrinkle injections & dermal filler) clients must be over 21 years old, for skin treatments clients must be over 18 years old. BLACKABEY’S strictly adheres to guidance published by the General Medical Council and ensures that all practitioners are fully educated in this. We reserve the right to refuse to perform treatments on any guest who is under the age of consent (UNDER 18 YEARS OF AGE).

Booking Confirmation

All bookings made online or by phone will receive an email confirmation and a reminder SMS or text unless you choose to opt out of all communications.

Services require a compulsory 50% deposit of the treatment/consult price at time of booking. This deposit is not refundable upon attendance of your appointment or redeemable against treatments or products. The remainder 50% treatment/consult price is taken on the day of treatment.

the 50% deposit payment is held for 3 months. If the patient does not attend or repeatedly cancels their appointment on a maximum of 3 occasions the deposit payment will not be refunded. if the patient cancels the treatment with less than 3 working days notice the deposit payment will also not be refunded.

If a patient does not comply with preparation treatment prior to their treatment they risk the treatment being cancelled or rescheduled in order to ensure patient safety. Attempts are made by Blackabey’s to contact the patient to ensure compliance however if there is no evidence of preparation being taken and the patient does not contact Blackabey’s to purchase preparation/cancel treatment then the deposit will not be refunded.

Cancellations - Services

We know your time is valuable, and ours is too. Out of respect for our staff and our other clients, we ask that you give us at least 3 working days notice if you need to reschedule or cancel an appointment. You can do this by calling 0113 418 0686 OR EMAIL BLACKABEYS@GMAIL.COM.

Missed appointments or those cancelled with less than 3 working days’ notice will result in the loss of your deposit. If cancellation/ Non attendance of appointment is part of a prepaid treatment program or package a fine of £35 will need to be paid in order to rebook the treatment/consult. If a patient does not attend or comply with preparation treatment in advance of the treatment the deposit will be forfeited.

Where possible BLACKABEY’S will notify clients of changes, cancellations or amendments to their appointment as soon as possible. We endeavour to ensure your appointments remain unchanged but in unforeseen circumstances we may be required to cancel a booking.

Concerns

At BLACKABEY’S all our treatments are carried out by Dr Victoria Blackabey. If you have had a treatment that you are unsatisfied with please contact us immediately. If you have concerns during your treatment, please raise your concern with the clinician immediately. They will listen carefully to your concerns and do what they can to correct any problems.

Treatment Packages

If you change your mind about a treatment or package you have purchased within 14 days, and none of your sessions has been redeemed yet, we are happy to offer an exchange for another service. After this period, or if a session has been used, we are not able to offer refunds on treatments or packages. 

Please be advised that we do not offer refunds on any discounted treatments or packages except when a medical exemption is presented. If you have been advised not to continue with your course due to medical reasons, please obtain a medical report from your doctor within 28 days of providing notice to Blackabeys.

wedding package treatments are separated into 6 month, 3 month and 1 month plans. There is also the opportunity to proceed with a bespoke treatment plan, however this is on consultation only. Wedding package treatments are then subcategorised by whether microneedling or chemical peels are included. All treatment packages require a 50% deposit at booking and further payments must be paid at agreed timings set out in your treatment plan. This is documented on your patient notes stored on Aesthetic Nurse Software. As part of paying your package deposit, the 2 week cooling off period is respected. If there is a cancellation of the package once the treatment package has started we do not offer refunds and the full price of the treatment package must be completed.

If in the package there is a treatment deemed unsuitable for medical reasons by the practitioner a credit will be given to the value of the treatment to be used on another treatment that we offer (excludes Botulinum toxin injection and Alumier MD products) in the next 6 months. If this is not redeemed in the 6 months following application of credit, the patient will lose the credit.

All dermal filler and skin booster treatments are included in the wedding packages up to 1 ml of treatment. If further product is required this will incur an additional cost.

Botulinum toxin injections are not included in the wedding packages and are paid for separately by the client.

The AISLE Bridal customers who purchase a dress with the salon are eligible to 10% off their chosen wedding package. This cannot be used with any other monthly offer or the refer a friend scheme unless the credit received in the refer and friend offer is used on a treatment outside of the wedding package already purchased and is in keeping with the terms and conditions in the refer and friend scheme. Aisle brides must show receipt of purchase on agreement to the wedding package to receive the wedding package.

Wedding Fayre customers are eligible to 10% off their chosen wedding package if the purchase is made within 14 days of the date of the fayre. Proof of attendance must be demonstrated on agreement to the wedding package in order to be eligible for the discount. This cannot be used with any other monthly offer or the refer a friend scheme unless the credit received in the refer and friend offer is used on a treatment outside of the wedding package already purchased and is in keeping with the terms and conditions in the refer and friend scheme.

Marry Me Cyprus Brides are eligible to an exclusive offer and proof of purchase of a wedding deposit for 2024 onwards with Marry Me Cyprus is required in order to be able to proceed with this offer. Marry Me Cyprus customers are eligible to a complimentary virtual consultation for their first appointment only or a 20% discount of their first Face-to-face consultation. Virtual consultations are for skincare products only and cannot be used instead of a face-to-face consultation for in clinic treatments. A customer cannot have both a complimentary virtual consult and a face-to-face appointment at a discounted price. All other follow up appointments are at full price unless purchasing a wedding package from Blackabeys. Wedding packages are purchased by customers of Marry Me Cyprus following face-to-face consultation only. If the customer pays for 50% of the wedding package at first consultation then they will receive a 10% discount off the full price of the package only. Please see wedding package terms of use for further information. This cannot be used with any other monthly offer or the refer a friend scheme unless the credit received in the refer and friend offer is used on a treatment outside of the wedding package already purchased and is in keeping with the terms and conditions in the refer and friend scheme.

Pin Up Beauty customers are eligible to 10% off their first treatment when proof is provided of attendance to pin up beauty in the past 8 weeks prior to completion of their first treatment by Dr Victoria Blackabey. Customers will not be eligible for this discount if proof cannot be provided of completion of treatment at pin up beauty within the 8 week timescale provided. This cannot be used with any other monthly offer or refer a friend scheme and excludes botulinum toxin treatment. Regular customers (Defined as Pin up Beauty clients who complete more than 6 treatments a year) may also receive a 10% discount on Blackabey Microneedling and mesotherapy treatment courses (set of 3 or 6) and Chemical peel treatment courses (set of 3 or 6). Proof of regular attendance to Pin up Beauty and completion of more than 6 treatments a year is required in order to receive this offer.

Rachel Wright beauty customers are eligible to 10% off their first treatment when proof is provided of attendance to Rachel Wright Beauty in the past 8 weeks prior to completion of their first treatment by Dr Victoria Blackabey. Customers will not be eligible for this discount if proof cannot be provided of completion of treatment at Rachel Wright Beauty within the 8 week timescale provided. This cannot be used with any other monthly offer or refer a friend scheme. The exclusive offer for Rachel Wright customers does not include botulinum toxin injections.

Clients of Balance Fitness Studio in Horsforth, Leeds, are entitled to an introductory 10% off their first treatment package. The patient must attend their initial face-to-face consultation (RRP £70) in order to ensure their safety with regards to further treatment. They will then be given the offer of purchasing a treatment package (this excludes botulinum toxin treatment). This can either be a course of microneedling or a course of chemical peel treatments. A microneedling and mesotherapy course or chemical peel treatment is sold as a set of 3 or 6 only. Clients of Balance Fitness studio must show proof of attendance to Balance Fitness studio in the past 8 weeks prior to completion of their first treatment by Dr Victoria Blackabey. Customers will not be eligible for this discount if proof cannot be provided of attendance within the 8 week timescale provided. This cannot be used with any other monthly offer or refer a friend scheme. This introductory offer is not for use with any treatment involving injectables such as Botulinum toxin, dermal fillers, polynucleotides or skin boosters.

Treatment packages as part of the RENEW RESTORE REGENERATE program are paid in six monthly installments. The first installment must be paid on agreement to proceed with the treatment program. All of the other treatments must be paid on the first day of every month unless stated otherwise by Dr Victoria Blackabey in the patient’s treatment plan or medical notes held on Aesthetic Nurse Software. This treatment package cannot be used with any other monthly offer or refer a friend scheme. There is a two week cooling off period on payment of the first monthly installment. Once treatments have started we are unable to refund the payments given and the patient must pay all 6 monthly installments. If the treatment program is deemed unsuitable for medical reasons, the installments can be used to pay for other treatments available as credit (excludes Botulinum toxin injections and Alumier MD Skincare). Medical reasons for termination of treatment program must be supported with a medical report by your doctor within 28 days of providing written notice to Blackabeys.

Refer a friend

Patients will receive a £25 credit to use on their next treatment (£200 minimum spend) when they refer a friend. The friend must also have completed treatment (not including face to face appointment) to a minimum spend of £200 before the credit to the referrer will be issued.

The referred friend will also receive a £20 credit once they have completed their first consultation and their first treatment of a minimum spend of £200. The payment of the first consultation is not included in the minimum spend total.

The minimum spend for both the patient and the referred friend does not include botulinum toxin injections.

The referring patient is able to refer an unlimited number of friends and credit can be accumulated for a treatment as long as the treatment is performed within the 6 months of receiving the first credit. All referred friends must also complete their first treatment in the first 6 months from referral. If the referred friend has already been referred in the past by another patient or by the referring patient in question then this patient is not permitted to be re-referred.

Refer a friend credits cannot be used in combination with any other monthly offers unless stated in writing by Dr Blackabey and cannot be used to discount the price of a treatment as part of an already purchased treatment package.

Client Consultation Forms

All new clients will be requested to complete a Client Consultation form before our clinicians can perform any treatments on you. Failure to do so will result in us refusing to perform your treatments. Please advise us of any health conditions, allergies, or injuries which could affect your service when completing this form. It is your responsibility to let us know of any changes in your circumstances before your treatment goes ahead. We also reserve the right to ask you to complete the Client Consultation form every 6 months so that we can update our records.

Personal details taken from clients during consultation procedures are protected under the Data Protection Act.

Your client records are stored securely and protected by the Data Protection Act. If you wish to access the records we hold on your personal file we can provide a report on request.

Medical Disclaimer

The use of and indications for the products that patients will be treated with will be explained by the practitioner and patients will have the opportunity to have all questions answered to their satisfaction prior to treatment. It is the patient’s responsibility to seek further clarification from their practitioner if questions about the procedure remain, this must be done prior to treatment.

Clients will be specifically informed of the following common injection-related reactions: redness, swelling, pain, itching, bruising and tenderness at the treatment site. These reactions are generally described as mild to moderate and typically resolve spontaneously a few days after treatment. These reactions are normal and are to be expected. Again, clients must clarify any doubts with their practitioner prior to treatment.

For muscle relaxation injections with Botulinum toxin Type A: Patients will be advised by their practitioner of the expected outcomes and risks associated with this treatment based on the current product Summary of Product Characteristics (SmPC). In particular, practitioner and patient have discussed realistic outcomes regarding the onset of action and the duration of effect, together with the potential side effects including those relating to the site of injection and the generalised common and uncommon side effects including headaches, muscle activity disorders (raised eyebrows), feeling of heaviness in the upper part of the face, accumulation of fluid in the eyelids (eyelid oedema), drooping eyelids (eyelid ptosis), inflammation of the eyelid, eye pain, blurred vision, fainting, noises in the ears (tinnitus), nausea, dizziness, muscle twitching, muscle cramps, localised muscle weakness in the face (drooping eyebrow), dry mouth, flu symptoms, influenza, bronchitis, inflammation of the nose and throat, infection and in rare cases, excessive muscle weakness and difficulties in swallowing.

The practitioner will also inform clients that depending on the product used, area treated, skin type and the injection technique, the effect of anti-wrinkle treatment typically lasts between 2 and 4 months. In some cases the duration may be shorter or longer. BLACKABEY’S accepts no responsibility for the effects of treatment lasting longer or shorter than the expected timeframes, and any follow-up treatments will be regarded as a new treatment requiring payment.

Other types of reaction are rare, but approximately one in every 10,000 patients treated with a dermal filler has experienced localised allergic reactions after one or more injection treatments. These have usually consisted of swelling and firmness at the treatment site, sometimes affecting the surrounding tissues. Redness, tenderness and rarely acne-like formations have also been reported. These reactions have either started a few days after injection or after a delay of several weeks. They have been described as mild to moderate and self-limiting, with an average duration of two weeks. In rare instances such reactions or lump formations like granulomas have persisted for a number of months. BLACKABEY’S practitioners will ensure that clients have been made aware of this before treatment begins, and it is the clients’ responsibility to raise any concerns with their practitioner before treatment commences.

BLACKABEY’S will not be held liable for any side effects caused as a result of safe and proper treatment if prior explanation about the associated risks has been given. On very rare occasions (less than one in 15,000) prolonged firmness, abscess formation or greyish discolouration at the implant site has occurred. These reactions can develop weeks to months following the injections and may persist for several months but normally resolve with time. Even more rarely, the formation of a scab and sloughing (shedding) of tissue at the treatment site has been noted, which could result in a shallow scar. A report published in 2012 discussed 32 reported incidents of blindness following dermal filler treatment in areas including the glabellar frown lines, under eye area, and temple1. In a separate study published in 2013, of the 6 visual disturbance cases reported, 3 were following glabellar frown line treatment with dermal filler2. Should any of these side effects occur after treatment, BLACKABEY’S cannot be held responsible.

Depending on the product used, area treated, skin type and the injection technique, the effect of dermal filler treatment can last 4 – 12 months. In some cases the duration may be shorter or longer. Follow-up treatment will help to maintain the desired correction. All follow up treatments are treated as a new, separate procedure and will therefore incur further costs in line with those on the BLACKABEY’S website.

In the event of an adverse reaction clients will be advised by their practitioner to seek further help/consultation immediately. BLACKABEY’S will not be held liable for adverse reactions to treatments.

Suitability for Treatment

As with any medical procedure, a full medical history and facial assessment is required before treatment. If our BLACKABEY’S practitioners feel that on the day of treatment the client is not suitable or would not benefit from the treatment being delivered, the treatment will not go ahead. We strongly encourage all clients to consider all treatments prior to undergoing them and not rush into any decisions. Clients are encouraged to ask as many questions as they need both prior to, and on the treatment day.

Aftercare

After your treatment the clinician will provide aftercare advice. Please follow the aftercare stated to maintain results. The results from each treatment will differ from client to client. Further treatments may be required to achieve the realistic results explained in the consultation. Blackabeys will not be held accountable for lack of compliance with aftercare and will not issue a refund for treatments already provided.

Patients undergoing muscle relaxing injections are advised to consider booking a follow up appointment 2-4 weeks post treatment. The treatment cost covers the price of muscle relaxing treatment up to a total 100 units of botulinum toxin. If a patient requires a total of botulinum toxin over 100 units on review then an additional cost will be incurred. This price will then be added to the total price of treatment for future muscle relaxant treatment to ensure adequate coverage.

Purchase of Alumier MD products

It is recommended that the patient purchases Alumier MD products through the Alumier MD portal that is prepared for the patient on initial consultation. If no products are purchased during a 6 month time period then your portal will become inactive and you will need to book another face to face consultation to assess and adjust your treatment plan appropriately. This is for your own safety. If any concerns with the Alumier MD products are raised please contact Blackabeys as soon as possible via email at blackabeys@gmail.com. Blackabeys is not accountable for the delivery, refund or exchange of products purchased through the Alumier MD website.

If Alumier MD products are directly purchased through the clinic; these are non refundable and not suitable for exchange under any circumstance. The resale of Alumier MD products is strictly prohibited and is detailed further on the Alumier MD website. Any evidence of resale will be escalated to Alumier MD to proceed with legally if deemed appropriate.

Transaction Data

BLACKABEY’S processes payment via third-party transaction service providers (Adyen, Izettle and/or Stripe). BLACKABEY’S does not hold any personal payment data / transaction data on their own systems. The basic set of Transaction Data collected (in transactions that are processed by our service provider for the Merchant (BLACKABEY’S), includes some or all of the following types of Personal Data about shoppers:

  1. First and last name (this could be as provided by the shopper, as registered with the payment method or as present on the card)

  2. Unique identifier (PAN or other unique identifier such as an email address) registered with the payment method, which may uniquely identify the shopper

  3. IP address

For some payment methods, and types of contracts – for example physical goods deliveries, and potentially configured by the Merchant – the Personal Data may include:

  1. Billing address

  2. Delivery address

  3. Telephone number

  4. Email address

  5. Payment device technical information

  6. Shopping cart information

Execution of a Subject Erasure Request (SER)

Due to obligations under the Dutch Civil Code, items 1 and 2 will be retained for at least 7 years after the fiscal year of the transaction.

Transaction service providers (Adyen, Izettle and/or Stripe) will remove items 1-13 for identified transactions, if they exist, from the Customer Area available to the Merchant under the following conditions:

  1. The Merchant has indicated that the shopper does not have a recurrent contract. Note: if the shopper has a recurrent contract, they will be unable to fulfil a SER until the Merchant terminates that recurrent contract.

  2. The Personal Data will be replaced with **REDACTED** within the Customer Area upon request of the Merchant.

  3. During the maximum chargeback period, the Personal Data may be provided to the Merchant (again) as part of the defense process to support merchant’s fraud and risk controls.

  4. Items 1-13 may be retained to support obligations under the Dutch Anti-Money Laundering and Anti-Terrorist Financing Act for at least 5 years after the end of the business relationship with the Merchant, as part of the legal obligations in relation to servicing the Merchant. In the unlikely situation that the service provider determines a transaction and the related data to be in scope of this legal obligation, they may be compelled by law not to disclose this fact to the Merchant or the data subject.

  5. The service provider will remove remaining data from within its own systems at the earliest reasonable moment after the maximum chargeback period and the end of the payments-related regulatory and legal compliance periods.
